Terms of Service

The agreement between you and us. It is short on purpose.
Who we are
California Safety Programs is the website and product of Luminescent Touch LLC, which has filed “California Safety Programs” as a fictitious business name. Luminescent Touch LLC has also done business as Luminescent Compliance, and that name may appear on Stripe receipts and card statements for purchases from us. “We” and “us” in these terms mean Luminescent Touch LLC, and it is Luminescent Touch LLC you are contracting with. Reach us through the contact form or at support@californiasafetyprograms.com.
What you are buying
A tool that produces written health and safety programs from the answers you give it, keeps them versioned, and reminds you when they are due for review. What each tier includes is on the pricing page, and two complete sample programs are published so you can read the real output before buying.
- Starter — $147 for the first year, then $297 a year. The first-year price is available once per customer; a customer who has already had it pays $297
- Pro — $599 a year
- Single document — $99, one payment, no renewal
Renewal and cancellation
Starter and Pro are subscriptions and renew automatically every year on the anniversary of your purchase, at the renewal price above, until you cancel or we decline a future renewal under the seller-nonrenewal section below. You are told this and asked to agree to it before you are taken to payment, and again on the payment page itself.
You can cancel at any time, online, from your billing page. Cancelling stops the next charge. It does not remove anything you have already downloaded, and it does not delete your account. If you cannot sign in, or cancelling online does not work, email us and we will cancel it for you — you should not have to fight a page to stop paying us.
A single-document purchase is a one-off payment and never renews.
Upgrading from Starter to Pro changes the subscription you already have. It does not start a second one. You pay the difference for the rest of your current year, which is shown to you before you agree, and the subscription then renews at the Pro price on the renewal date it already had.
When we do not renew a subscription
For a new subscription accepted under this version of these Terms, we may decline a future renewal when we cannot provide the required renewal or fee-change notice through a usable communication channel. We will use the active communication methods reasonably available for your account to tell you the paid-through date, when subscription benefits end and how to cancel. If no usable channel remains, we record our contact attempts and results.
We stop the affected scheduled annual renewal and preserve access through the paid term. We do not automatically restart billing or charge for the missed renewal period. Previously downloaded versions remain available under your purchase terms. Existing invoices or amounts already owed are not erased by a nonrenewal notice; contact us about any unexpected charge. Returning after expiration requires a fresh purchase, fresh consent and a new acknowledgment. A customer who already received the Starter introductory year returns at the regular annual price.
This seller-nonrenewal provision is prospective. Publishing it does not rewrite an existing customer's agreement. Any applicable changes to an existing subscription require the notice and assent required by law and that customer's governing agreement. We do not use this provision to authorize a renewal without the required notice or consent.
The October 19, 2026 Terms remain available.
Refunds
Each payment — a first purchase, a renewal or an upgrade — is refundable in full for seven days from the payment, until you download an editable file under that purchase. Reading the watermarked preview never counts, and regenerating a program does not start a new window. A full refund of a subscription payment also cancels the subscription. The full terms, and the reasoning behind them, are on the refund policy page.
The documents are yours
Every program this generates for you is yours to use, edit, print, distribute to your employees and keep — during your subscription and after it ends. We claim no ownership of them and no licence back. Download and keep your own copies of what you want to keep.
When a subscription ends, the versions you downloaded while it was active stay available to download again from your account. A version you had not downloaded, or one generated afterwards, needs a subscription. So does anything downloaded under a payment that was refunded in full.
The software, the site and the underlying templates remain ours. Please do not resell the generated documents as a product of your own, scrape the site, or use it to build a competing generator.
What this is not
We are not your lawyer, and this is not legal advice. A generated program is a starting point. It should be read, adapted to what actually happens at your workplace, and reviewed before you adopt it.
We do not guarantee any inspection outcome. Cal/OSHA judges a program by whether it is effective — whether it is followed, whether your employees know about it, whether it was communicated to them, and whether the hazards it finds actually get fixed. No document can do those things for you, and we will not pretend otherwise to make a sale.
We also do not walk your site, run air monitoring, fit-test your crew, deliver their training, or stand next to you in an inspection. Those need a person on site.
Our commitments and product limits
We will provide the products and features expressly described for your purchase, subject to the disclosed catalogue and supported-work limits. California Safety Programs does not inspect your workplace, perform workplace exposure sampling, provide legal representation or implement your program. Employers must complete the indicated sections, review and adapt the output, and implement and maintain their program.
We do not promise uninterrupted availability or that the generated documents address every requirement of every workplace. Nothing in this section excludes a warranty, duty or remedy that cannot lawfully be excluded, excuses errors in our software, or reduces our express delivery or refund commitments.
Your side of it
The programs are only as accurate as the answers you give. You are responsible for the accuracy of what you enter, for reviewing the output before adopting it, for keeping your login credentials to yourself, and for the personal information about your employees that you choose to put into records here — see privacy.
Availability
We will keep the service running and your data backed up, but we do not promise uninterrupted availability. This is a small operation and we would rather say so than print an uptime number we cannot stand behind. Download your documents and keep your own copies.
Liability
Only to the extent permitted by applicable law, and subject to the exceptions below, our aggregate liability for an ordinary breach of this agreement is limited to the greater of (a) the amount you paid us for the purchase giving rise to the claim and (b) the amount you paid us for the service during the twelve months before the event giving rise to the claim.
Subject to those same exceptions, we exclude indirect or consequential lost profits or lost business only to the extent the law permits that exclusion. We do not categorically exclude regulatory penalties or losses arising from our own statutory duties.
Neither the cap nor the exclusion applies to fraud, willful injury or misconduct, gross negligence, or any liability, duty or remedy that cannot lawfully be limited. They do not reduce refunds or other remedies we expressly promise, permit us to retain money that must be returned, or excuse our obligation to deliver what we expressly agreed to sell. These limits do not transfer responsibility for our own conduct to you.
Ending it
You can cancel a subscription from the billing page and stop using the service at any time. Contact us if you want to request closure of your account. Account closure does not necessarily erase transaction, payment, consent, security, or other records that we reasonably need to retain. We may suspend an account that is being used to attack the service or break the law, and we will tell you why.
Changes and governing law
We will retain the Terms accepted for each purchase. We will give account holders a clear, retainable notice of material changes and how to cancel before those changes take effect. We will obtain new assent where required. Publishing a new version alone does not rewrite an earlier agreement. A fee change will receive the applicable advance notice, and a new price will not be applied to a renewal without the required notice. If we cannot meet the notice requirements, we will follow the nonrenewal procedure instead of charging that renewal.
The liability and product-limit provisions in this version apply to new purchases accepted under this version. They do not retroactively reduce rights under an earlier purchase. The earlier October 26, 2026 Terms and October 19, 2026 Terms remain available. These terms are governed by the law of the State of California.
